Terms of Service

Last updated: June 2025  ·  Version 1.0

Please read these Terms of Service ("Terms") carefully before using the Testly platform. By creating an account or using any part of the service, you agree to be bound by these Terms.

1. Who We Are

Testly is an online assessment platform that allows educators to create, manage, and deliver assessments to their students. References to "Testly", "we", "us" or "our" mean the operators of the Testly platform.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract to use Testly as an educator. By signing up you confirm that you meet these requirements.

3. Your Account

4. Acceptable Use

You agree to use Testly only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

5. Student Data

When you onboard students, you represent and warrant that:

6. Intellectual Property

You retain ownership of the assessment content (questions, descriptions, etc.) that you create. By using Testly, you grant us a limited, non-exclusive licence to host, display, and process your content solely to provide the service to you.

The Testly platform, branding, code, and design remain the exclusive property of Testly's operators.

7. Credits and Payments

Some features require purchased credits. Credits are non-refundable once consumed. Unused credits may be refunded at our discretion within 14 days of purchase. We reserve the right to change credit pricing with reasonable notice.

8. Free Plan Limits

The free tier has limits on the number of school profiles and assessments that can be created. These limits are per account and are tracked on a lifetime basis — deleting items does not reset the counter.

9. Availability and Changes

We strive to keep Testly available at all times but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the service with reasonable notice. We may update these Terms; continued use after changes constitutes acceptance.

10. Disclaimer of Warranties

Testly is provided "as is" without warranties of any kind. We do not guarantee that the service will be error-free, secure, or suitable for any particular purpose.

11. Limitation of Liability

To the maximum extent permitted by law, Testly and its operators shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform.

12. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be subject to the exclusive jurisdiction of Nigerian courts.

13. Contact

For questions about these Terms, please contact us through the Testly platform or the contact information provided on our website.
